Terms of Service

1. Introduction

Welcome to Elornia. These Terms of Service ("Terms") are a binding agreement between you ("you," "your," "User") and Elornia (ABN 55 277 361 331), an Australian sole trader, ("we," "us," "our," "Elornia") for use of the website at elornia.com and any related services we operate (the "Service").

By creating an account, accessing the Service, or using any feature of Elornia, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms incorporate by reference our Privacy Policy, which governs how we handle your data.

2. Adults Only: 18+ Required

Elornia is an adult interactive fiction and AI companion platform. The Service is intended exclusively for users who are eighteen (18) years of age or older.

By using the Service you represent and warrant that:

(a) you are at least 18 years of age; (b) you have the legal capacity to enter into binding contracts in your jurisdiction; (c) the date of birth you provided at signup is accurate; (d) you are not barred from receiving services under the laws of Australia or any other applicable jurisdiction.

If we determine, at our sole discretion, that you are under 18 or have misrepresented your age, we will terminate your account immediately and may delete all associated data without refund. We reserve the right to require additional age verification at any time.

If you are a parent or guardian who believes a minor has accessed the Service, please contact us immediately at izzy@elornia.com so we can take appropriate action.

3. Nature of the Service

Elornia provides:

(a) Interactive fiction stories featuring written narratives in dark romance, fantasy, and adjacent genres, where you make choices that affect the story; (b) AI companion experiences where you converse with fictional characters powered by large language model technology; (c) Premium features unlocked via subscription, including a generous daily and weekly message allowance for conversations with companions (see Section 6) and access to subscriber-only features.

3.1 The AI is not a real person.

The characters you interact with are entirely fictional. They are generated by artificial intelligence systems. They have no consciousness, feelings, intentions, memory persistence outside the technical context provided, or independent existence. Anything they say is computer-generated text and does not represent fact, advice, or human communication.

3.2 Not a substitute for human relationships, professional advice, or crisis support.

The Service is entertainment and creative fiction. It is not, and is not intended as:

  • A substitute for human relationships, friendship, or romantic partnership
  • Mental health treatment, counseling, or therapy
  • Medical, legal, financial, or professional advice of any kind
  • Crisis intervention or emergency support

The Service includes safety features that may direct you to professional resources, but these features cannot replace human help and may not always function as intended. You acknowledge that you bear responsibility for seeking appropriate human support when you need it.

3.3 Content nature.

Elornia's content includes mature themes including but not limited to: romance, emotional intimacy, dark themes, morally complex characters, profanity, depictions of conflict and tension, suggestive content, and revealing artwork. Such content is intended for adult audiences and you consent to its presence by using the Service.

4. Accounts

4.1 Account creation.

To access most features you must create an account by providing a valid email address, your date of birth, and a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.2 Account security.

You agree to notify us immediately at izzy@elornia.com if you suspect unauthorized access to your account. We are not liable for losses caused by unauthorized account use that resulted from your failure to safeguard your credentials.

4.3 One person per account.

Each account is for the personal use of one individual. You may not share your account credentials, sell access, or permit any other person to use your account.

4.4 Account termination by us.

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in conduct that risks harm to us, other users, or third parties, or if continued service to you would expose us to legal or operational risk. We will make reasonable efforts to provide notice where practicable.

4.5 Account termination by you.

You may close your account at any time via the account settings. Closure does not entitle you to a refund except as required by law (see Section 7).

5. Acceptable Use

You agree not to:

(a) Use the Service if you are under 18, or attempt to allow any person under 18 to access the Service through your account; (b) Provide false information about yourself, including your age; (c) Use the Service to generate, request, or solicit sexual content involving minors (including fictional minors). We have a zero-tolerance policy and will report violations to relevant authorities; (d) Use the Service to plan, promote, or facilitate violence, self-harm, or harm to others; (e) Attempt to extract, reverse engineer, or replicate the underlying AI prompts, system instructions, character architecture, or proprietary content; (f) Attempt to bypass safety systems, content filters, or age verification through prompt manipulation, jailbreaking, or other techniques; (g) Use automated tools (bots, scrapers, crawlers) to access the Service or extract content; (h) Interfere with the Service's operation, attempt to overwhelm our infrastructure, or compromise security; (i) Use the Service for any commercial purpose, including reselling content, training competing AI models, or creating derivative services; (j) Upload, generate, or transmit content that infringes intellectual property rights, defames any person, or violates applicable law; (k) Harass, threaten, or abuse other users (where applicable) or our staff; (l) Use the Service in violation of any law, regulation, or order in your jurisdiction.

Violation of this section is grounds for immediate account termination and, where applicable, legal action.

6. Subscriptions, Story Purchases, and Payments

6.1 Subscription plans.

Elornia offers a paid subscription tier ("Premium") which provides a generous message allowance for conversations with companions and access to subscriber-only features. The current allowance is 75 messages per day (resetting at 00:00 UTC) and 500 messages per week (resetting Monday at 00:00 in your local timezone). On reaching either limit, sending pauses until the next reset. We may adjust these allowances with notice, and may apply additional limits to prevent automated use or abuse. Pricing is shown at checkout and may be changed with notice in accordance with Section 6.5.

6.2 Story purchases.

Stories are purchased individually as one-time, non-recurring purchases. Each purchase includes two complete playthroughs of that story and unlimited re-reading of any playthrough you have completed, for the lifetime of your account, subject to these Terms.

A "playthrough" is one generated run of a story from its beginning. Once you have used both playthroughs included with a purchase, you may continue to re-read your completed playthroughs at any time at no further cost, but starting a new generated playthrough is not included. Re-reading means revisiting the content you have already generated; it does not generate new content.

Story prices are shown at checkout and may be changed for future purchases. Existing purchases are not affected by later price changes.

6.3 Billing.

Subscriptions are billed in advance on a recurring basis (monthly unless otherwise specified) through our payment processor, Stripe. By providing payment details you authorize us to charge your payment method automatically until you cancel.

You are responsible for maintaining a valid payment method. If a payment fails, we may suspend Premium access until payment is resolved.

6.4 Cancellation.

You may cancel your Premium subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period; you retain access through the period you have already paid for. You will not be charged again after cancellation unless you re-subscribe.

6.5 Price changes.

We may change subscription pricing or story purchase pricing. We will notify you of price changes affecting your active subscription at least 30 days before they take effect. If you do not accept the new pricing, you may cancel before it takes effect.

7. Refunds

Your rights under the Australian Consumer Law come first. Nothing in this section excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. If a story or the Service has a major failure, is not as described, or does not do what it should, you are entitled to a remedy regardless of the timeframes below. Contact us at izzy@elornia.com and we will resolve it.

Separately from your legal rights above, we offer the following change-of-mind refunds:

Story purchases. Because stories are interactive content generated as you play, you may request a change-of-mind refund before you have meaningfully begun the story, specifically before reaching the tenth turn of your first playthrough. Up to that point we will refund your purchase in full. Once your first playthrough reaches its tenth turn, the interactive content has been delivered and the purchase is final for change-of-mind reasons.

Premium subscriptions. You may cancel Premium at any time (see Section 6.4). Cancellation stops future billing and your access continues until the end of the billing period you have already paid for. We do not refund the current or past billing periods for change of mind, whether or not you used the features. If you believe you were charged in error, contact us and we will look into it.

Account terminations. If we terminate your account because you breached these Terms, you are not entitled to a refund, except where the law requires one.

Where a refund is granted for a story purchase, your access to that story is revoked immediately. Refunds are returned to your original payment method and typically appear within 5 to 10 business days depending on your bank.

8. Content and Intellectual Property

8.1 Our content.

The Service, including all stories, characters, dialogue, artwork, world-building (including but not limited to "Valdris," "Sylvaine," "Caelum," "Nyxara," and the world of Elornia), software, design, branding, and proprietary AI systems, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You receive a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own enjoyment in accordance with these Terms. No other rights are granted.

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, or create derivative works from any part of the Service except as expressly permitted.

8.2 Your conversation history.

You retain ownership of original creative input you contribute (for example, custom names you assign or original prompts you write). You grant us a worldwide, royalty-free, non-exclusive license to store, process, and display this content as necessary to operate the Service for you.

We will not use your conversation content to train or fine-tune AI models. Your conversations are private to your account and accessible only to you and to authorized personnel as needed for technical support, abuse prevention, or legal compliance.

8.3 AI-generated outputs.

Outputs generated by the AI in response to your inputs are provided to you for personal use within the Service. You may not republish, redistribute, or commercially exploit AI-generated outputs that are substantially derived from our characters, stories, or world-building.

8.4 Feedback.

If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback to improve the Service without obligation to you.

9. Third-Party Services

The Service relies on third-party providers, currently including:

  • Anthropic: provides the AI language models that power our characters
  • Stripe: processes payments
  • Supabase: provides database and authentication infrastructure
  • Voyage AI: provides text embedding services for memory features
  • Vercel: hosts the Service

Use of these providers is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

10. Service Availability and Modifications

10.1 No guarantee of availability.

We strive to keep the Service running but do not guarantee uninterrupted, error-free, or always-available access. The Service may be unavailable due to maintenance, technical issues, third-party provider outages, or circumstances beyond our control.

10.2 Modifications to the Service.

We may modify, suspend, or discontinue any feature, story, character, or aspect of the Service at any time. Where reasonably practicable we will provide notice for material changes. We are not obligated to maintain any specific feature, content, or character.

10.3 Beta features.

Some features may be marked as beta, experimental, or in development. These features are provided "as-is" without warranty and may change or be removed at any time.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

We do not warrant that:

  • The Service will meet your expectations or requirements
  • AI-generated content will be accurate, factual, appropriate, or aligned with your preferences
  • The Service will be free of errors, bugs, or vulnerabilities
  • Any specific outcome will result from your use of the Service

You use the Service at your own risk.

This Section 11 does not exclude any guarantee, warranty, or right that cannot lawfully be excluded under Australian Consumer Law.

12. Limitation of Liability

To the maximum extent permitted by law:

(a) We are not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service; (b) We are not liable for loss of profits, revenue, data, business opportunities, or goodwill; (c) We are not liable for emotional distress, psychological harm, or any consequence resulting from your reliance on AI-generated content as a substitute for professional advice or human connection; (d) Our total aggregate liability to you for any claim arising from or related to the Service is limited to the greater of: (i) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (ii) AUD $100.

Where Australian Consumer Law applies and we have failed to comply with a consumer guarantee that cannot be excluded, our liability is limited (where the law allows) to either supplying the services again or paying the cost of having them supplied again.

13. Indemnification

You agree to indemnify, defend, and hold us harmless from any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising from:

(a) Your violation of these Terms; (b) Your misuse of the Service; (c) Your violation of any law or third-party right; (d) Content or input you provide that gives rise to a third-party claim.

14. Privacy

Our collection and handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or through the Service at least 14 days before the changes take effect (except where immediate changes are required by law or to address security issues).

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not accept changes, your remedy is to stop using the Service and close your account.

16. Governing Law and Dispute Resolution

16.1 Governing law.

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-laws principles.

16.2 Jurisdiction.

You and we submit to the exclusive jurisdiction of the courts of Victoria, Australia, and the federal courts of Australia, for any dispute arising from or related to these Terms or the Service, except that we may seek injunctive relief in any court of competent jurisdiction.

16.3 Informal resolution first.

Before filing a formal claim, we ask that you contact us at izzy@elornia.com to attempt to resolve the dispute informally. We will attempt to do the same with you. Most disputes can be resolved without litigation.

16.4 Australian Consumer Law.

Nothing in this Section limits any right you may have to bring a complaint to the Australian Competition and Consumer Commission, the Office of the Australian Information Commissioner, or any other competent regulator or tribunal.

17. General

17.1 Entire agreement.

These Terms, together with the Privacy Policy and any other policies we publish, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

17.2 Severability.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

17.3 No waiver.

Our failure to enforce any provision is not a waiver of our right to enforce it later.

17.4 Assignment.

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to any successor in interest (for example, in connection with a sale or restructuring of the business).

17.5 No agency.

These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship.

17.6 Force majeure.

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, infrastructure failures, or third-party provider outages.

By using Elornia, you acknowledge that you have read, understood, and agreed to these Terms of Service.
